The U.S. Supreme Court is expected to issue a major ruling on Tennessee’s ban on medical treatment for transgender youth, with legal experts calling it the term’s most significant case.
The case, United States v. Skrmetti, centers on S.B. 1, a 2023 law that prohibits puberty blockers, hormone therapy, and gender transition procedures for minors.
The Biden administration and the ACLU argue the law is discriminatory based on sex. Tennessee officials contend the law targets drug use, not gender.
Josh Blackman, a professor at South Texas College of Law, described it as “the biggest merits docket case,” while Ilya Shapiro of the Manhattan Institute said he is “focusing on Skrmetti.”
A federal appellate court upheld the law, prompting a Supreme Court review. If justices find no sex discrimination, Tennessee faces a lower legal hurdle. A contrary ruling would send the case back to the Sixth Circuit.
This is the Court’s first major transgender rights case since 2020.
