New York fines Walmart for shipping realistic toy guns

The New York law bans retailers from selling or shipping toy guns of certain colors — black, dark blue, silver, or aluminum — that look like real weapons.

Walmart has agreed to pay $16,000 in penalties and fees for shipping realistic-looking toy guns to New York, violating state law, Attorney General Letitia James announced Tuesday.

The settlement follows an investigation revealing that Walmart’s website allowed third-party sellers to ship at least 46 imitation firearms to various parts of New York between March 2020 and November 2023. State law prohibits toy guns resembling real weapons, requiring them to be brightly colored or transparent.

“Realistic-looking toy guns can put communities in serious danger and that is why they are banned in New York,” said James. “Walmart failed to prevent its third-party sellers from selling realistic-looking toy guns to New York addresses, violating our laws and putting people at risk.”

Under the agreement, Walmart must enforce stricter policies to block prohibited toy gun sales and terminate sellers who repeatedly violate the law.

Walmart neither admitted nor denied the allegations. The settlement stems from a broader effort since 2015 to regulate imitation firearms after high-profile incidents involving toy guns.
