Attorney General of the Federation (AGF), Lateef Fagbemi, made the request through his counsel, Chief Akin Olujimi (SAN), in response to a suit filed by Osun over unpaid LG allocations for March 2025.
The Federal Government has asked the Supreme Court to compel the Osun State Government to refund seven months’ worth of local government allocations.
Attorney General of the Federation (AGF), Lateef Fagbemi, made the request through his counsel, Chief Akin Olujimi (SAN), in response to a suit filed by Osun over unpaid LG allocations for March 2025.
In suit SC/CV/379/2025, Osun alleged that the Minister of Finance withheld the funds on instructions from the AGF—an allegation Fagbemi denies.
Fagbemi argued the state had no right to file the case, citing lack of locus standi, and accused it of contempt for not complying with a July 2024 ruling.
“The plaintiff has no right to sue on behalf of local governments,” he submitted. “If any LG has been wrongly deprived of its funds, it is the council itself—not the state government—that has the right to sue.”
He also dismissed Osun’s reliance on the 2004 AG Lagos v. AG Federation ruling as inapplicable.
