The family of Nnamdi Kanu has accused the Nigerian Bar Association of aiding injustice by remaining silent over what they call an unlawful terrorism trial based on a repealed law.
The family of Nnamdi Kanu has criticised the Nigerian Bar Association (NBA) for what it described as silence over the “unlawful” trial of the detained IPOB leader, according to a report from DAILY POST NIGERIA.
In a statement signed by Prince Emmanuel Kanu and titled “The NBA’s Silence Is Helping an Unlawful Court Case Against Mazi Nnamdi Kanu, And It Is Breaking Our Constitution,” the Okwu-Kanu family said the NBA had failed in its duty by not speaking out against a trial allegedly anchored on a repealed law.
The statement read, “The hard truth is that the NBA has failed in its duty, and its silence in the face of clear constitutional violations has allowed an unlawful and fake court case against Mazi Nnamdi Kanu to continue.” It argued that Kanu is being tried under the repealed Terrorism (Prevention Amendment) Act 2013, contrary to Section 36(12) of the Constitution and various Supreme Court decisions.
The family further stated that the applicable law is the Terrorism Prevention and Prohibition Act 2022, which requires double criminality. “Kenya has never accused, investigated, or charged Mazi Nnamdi Kanu with any crime of any kind,” it added.
Warning that the NBA’s silence “normalises abuses,” the family urged the association to publicly affirm that no Nigerian can be tried under a repealed law and to defend the Constitution actively.
