Kilmar Abrego Garcia, accused of human smuggling and linked to MS-13, is asking a Tennessee federal judge for release, arguing his detention is unlawful after he was “illegally” deported to a terrorist prison in El Salvador under the Trump administration. Although facing serious accusations, including drug and gun smuggling and soliciting nude photos of a minor, he is currently only charged with smuggling.

Garcia’s attorneys claim he has no felonies, no flight history, and no strong foreign ties. Despite being deported on March 15 with others under the Alien Enemies Act, the U.S. brought him back for prosecution.
His lawyer in a related Maryland case accused the government of “stonewalling” and urged the court to hold officials in contempt. “The government’s defiance has not been subtle,” Jonathan Cooper argued in his filing.
