Court dismisses Mohbad’s father’s suit against Naira Marley, Sam Larry

“The powers of the attorney general of Lagos state to prosecute or not to prosecute were absolute and could not be questioned,” Justice Olatokun ruled.

An Ikeja High Court has dismissed an application filed by Mr Joseph Aloba, father of late singer Mohbad, seeking to quash the legal advice that cleared Naira Marley and Sam Larry of involvement in his son’s death.

Justice Taiwo Olatokun ruled on Wednesday that “the powers of the attorney general of Lagos state to prosecute or not to prosecute were absolute and could not be questioned.”

Aloba’s counsel, Dr Wahab Shittu (SAN), argued the DPP’s advice “pre-empted the outcome of the coroner’s inquest,” and claimed vital suspects were prematurely discharged.

However, the Attorney General and DPP, in a counter-affidavit, maintained that the suspects were only discharged, not acquitted, and urged the court to dismiss the application “in the interest of justice.”
