Denver Public Schools is resisting federal orders to rescind gender-inclusive restrooms, risking a Title IX funding battle with the Trump administration.
Denver Public Schools has rejected the Trump administration’s directive to reverse its gender-inclusive restroom policy, setting up a clash over Title IX compliance.
Superintendent Alex Marrero accused federal officials of pushing an “anti-trans agenda through the weaponization of Title IX.” He pledged: “To our LGBTQ+ students, families, and supporters, we see you, and we will not stand for these attempts at your erasure.”
The Education Department’s Office for Civil Rights said the district violated Title IX by converting girls’ restrooms at East High School into all-gender facilities. Acting Assistant Secretary Craig Trainor warned that Denver’s actions “are creating a hostile environment for its students” and could jeopardize federal funding.
Marrero countered that the district had already addressed prior concerns, saying officials “shifted their legal theory to claim that a hostile environment was created.”
Title IX prohibits sex discrimination in federally funded schools, but its application to gender identity remains contested.
