Sean “Diddy” Combs’ attorneys claim the embattled music mogul may not have been mentally capable of committing the crimes he’s charged with due to substance use.
Combs, 55, faces at least 15 years in prison for federal sex trafficking, racketeering, and fraud charges and is currently held without bail. His trial begins May 5.
Prosecutors filed a motion Sunday to exclude psychiatrist Dr. Elie Aoun’s testimony, which allegedly supports the defense’s claim of diminished mental capacity.
“The noticed testimony relates to the defendant’s diminished capacity to form the mens rea required to commit the charged offenses,” the motion reads.
Combs previously argued the charges were racially motivated, calling the case “selective prosecution” under the Mann Act.
His lawyers assert no white person has faced similar charges.
Combs has pleaded not guilty to all counts.
The indictment accuses him of orchestrating a decades-long pattern of sexual abuse, including assaults and alleged drug-fueled “freak-offs.”
