The Department of State Services (DSS) has filed a lawsuit against Prof. Pat Utomi over his recent formation of a shadow government.

The suit, marked FHC/ABJ/CS/937/2025, was lodged at the Federal High Court, Abuja, accusing Utomi of attempting to destabilise the country and subvert the Constitution.

In the suit, DSS lawyers led by Akinlolu Kehinde (SAN) argued, “The planned shadow government is an aberration and a threat to the democratically elected government.”

They asked the court to declare the initiative unconstitutional and grant an injunction restraining Utomi and his associates from pursuing it.

Utomi had unveiled the shadow cabinet as a “national emergency response” to Nigeria’s worsening economic and security conditions.

However, political economist Prof. Anthony Kila backed the initiative, saying, “I fully support it. There’s nothing wrong with a credible opposition.”

The case, filed on May 13, is yet to be assigned to a judge, even as public debate around the move continues to intensify.
