Texas man sues Whataburger for nearly $1 million over onions on his burger

A Texas man has filed a lawsuit against Whataburger, claiming the fast-food chain served him onions despite his request to exclude them, causing an allergic reaction.

Demery Ardell Wilson filed the petition on April 25 in the 269th Judicial District Court of Harris County, alleging the company “failed to act in accordance with the appropriate standard of care,” resulting in “personal injuries.”

According to the lawsuit, Wilson visited a Whataburger on July 24, 2024, and consumed a meal that contained onions, which he had specifically asked to be removed. He later required medical attention due to the allergic reaction.

“There was a manufacturing defect in the food at the time it left [Wilson’s] possession,” the suit states, calling the food “unreasonably dangerous.”

Wilson is seeking between $250,000 and $1 million in damages. Representatives for Whataburger declined to comment when contacted by TODAY.com. The lawsuit does not specify which item Wilson ordered.
